Great news!  The Honorable Judge Terry Lewis has just returned his ruling and overturned the State of Florida’s Stay.  PIP now reverts to it’s previous status!  This means the original injunction stands. As more details come forth we will keep you informed.

FSMTA Executive Board and Chapter Members are in Tallahassee from across the State.  We are here to represent and speak on behalf of the Massage Therapy profession.  We will be providing Chair Massage in the Rotunda so that individuals can experience Massage Therapy first hand.   We will also visit each of our Legislators and educate them, as well as the public, on the many benefits of Massage Therapy as a valid medical modality.

The Florida State Massage Therapy Association (FSMTA) opposes Committee Bill S 7152 in its current form because of its negative impact on all Floridians including consumers, small business owners and health care providers. The FSMTA will continually evaluate its position as we learn more about specific dangers to consumers in not being able to access timely healthcare, health care providers being denied payment for indeterminate periods of time and an avalanche of litigation.

PIP UPDATE

As a counter move to the Temporary Injunction victory for LMTs, the State of Florida filed a motion to appeal the order, which put in an automatic Stay.  The attorneys, Luke Lirot and Adam Levine, which are representing Florida LMTs, Acupuncturist and Chiropractors immediately filed an Order to Vacate The Stay.  The Honorable Judge Terry Lewis called for oral arguments on Monday, April 1, 2013 in his Chambers. Both sides were able to present their argument.  Both sides were arguing the impact of harm.  The Judge is currently deliberating on the material and arguments presented, and we are awaiting his ruling.

In plain language what does this mean to the Florida LMTs, you currently cannot file any claims or receive any payment on PIP cases until the next ruling is rendered.
